ALTERAÇÕES NORMATIVAS E A BUSCA POR UM ESTATUTO QUE EFETIVE OS DIREITOS FUNDAMENTAIS AO NÃO TRABALHO E À PROFISSIONALIZAÇÃO DE ADOLESCENTES E JOVENS

Professional learning constitutes an effective public policy for professionalization, insertion in the labor market and combating child labor. Provisional Measure no. 1.116/2022, Decree no. 11.061/2022 and Bill no. 6,461/2019 convey changes that disarticulate the institute of professional learning in Brazil. The study discusses professional learning in the country, given the normative changes promoted by the provisional measure and the decree, and the perspectives arising from the bill. To this end, it reflects on the level of unemployment in the country, especially in relation to adolescents and young people; the main standards, characteristics, and numbers of learning in the period from 2016 to 2021 are exposed, based on official data and documents; and the main setbacks conveyed by the highlighted normative instruments are listed, according to the available data. A bibliographic and documental survey was conducted, based on consultation and critical reading of normative instruments, technical reports and scientific studies referring to the central theme of the study. The qualitative and quantitative analysis resulted from the association of diverse sources, from technical studies and information consolidated in the Professional Learning Bulletins. Through the application of the descriptive method, we sought to understand the contradictions and estimate the impact of normative changes for the public policy of professional learning. It is concluded that the modifications are harmful and therefore should not be accepted as they are. A proposal that is coherent with the protection and respect for the professionalization of adolescents and young people must facilitate the access of the most vulnerable people to the labor market. This is not the message that derives from the analyzed norms.
