INTERSECTIONALITY AS A PARAMETER FOR LABOR INSPECTION: PRELIMINARY CONSIDERATIONS

ABSTRACT: This article discusses the possibility of using the concept of intersectionality as an analytical tool for labour inspection. The research problem is whether the criterion of intersectionality is a key element for Labour Inspection to become more efficient in protecting workers belonging to groups of greater social vulnerability. It is based on the premise that, by using the concept of intersectionality, methodologies and strategies can be developed in order to assist the decision-making process regarding inspection actions, in its phases of management, planning and execution, providing greater effectiveness to the activity of labour inspection concerning the protection of workers belonging to groups of greater social vulnerability. The goal is to understand the intersectionality criterion and to verify if it is a fundamental parameter for labour inspection in relation to these groups. In this sense, the concept of Intersectionality is discussed and its use as an analytical tool is analyzed. Next, we seek to identify how intersectionality should be recognized in the very structure of Labour Inspection and in the inspection staff. The methodology applied was bibliographic research. We verified not only the possibility but also the need for the adoption of an intersectional perspective by Labour Inspection in order to fulfill its purpose of ensuring the protection of workers in the exercise of their labour activity, under the aegis of the constitutional principles of equality, non-discrimination and social justice in a Democratic and Socio-environmental State of Law.
