DIREITO À NÃO DISCRIMINAÇÃO ECONÔMICA NO BRASIL E A NOVA LEI DA IGUALDADE SALARIAL - LEI N. 14.611/23
Abstract
Social and economic barriers and the current centrality of human rights, as an axiological vector of the legal system; impels us to an exegetical process of necessary interweaving between the value of human dignity and the human right to non-discrimination. Drawing on extensive bibliographical research, with an emphasis on contributions from philosophy, the work proposes to face the digressions traditionally made to reconcile human rights and the denial of economic gender discrimination, highlighting the need to apply the human right not to discrimination with a specific cut, in the contemporary relationship between the employment available to women and the variable pecuniary consideration, second, the company's market power in view of the norms of Law n. 14.611/2023.
